1.General Description of the Service

• Wakil provides a personal safety service ("Service") that allows users to raise alerts in situations where they feel unsafe or at risk.
• The Service consists of a mobile application, a 24/7 Operations Command Center, and coordinated response resources. Wakil receives, monitors, and manages alerts, assesses situations, and coordinates appropriate actions based on operational conditions.
• The Service is a support and coordination service. Wakil does not guarantee that incidents will not occur, that harm will be prevented, or that specific outcomes or response times will be achieved.

2.Acceptance and Eligibility

These Terms govern the rights and obligations of both Wakil and the User.

By creating an account, you confirm that:

• You are a natural person
• You are at least 18 years old, or have been added by a parent or legal guardian
• You have the legal capacity to enter into this Agreement
• All information provided is accurate and complete
• You understand that these Terms are binding
• You agree to use the Service only in accordance with these Terms

If you do not accept these Terms, you must not use the Service.

3.Registration and Accounts

To use the Service, you must create a user account via the Wakil app or website. Registration requires providing personal details and valid payment information.

Parents or legal guardians may create accounts for minors aged 10–17. By doing so, the guardian confirms that:

• They are the legal guardian
• They are fully responsible for the minor's use of the Service
• They are responsible for all payments
• These Terms apply equally to the minor account

4.How the Service Operates

The Service is intended for situations where the User feels unsafe or lacks control.

When an alert is triggered:

• The alert is transmitted to Wakil's Operations Command Center
• Operators assess the situation and attempt to contact the User
• Wakil coordinates monitoring and, where appropriate, physical response
• Support continues until the situation is considered resolved

Alerts are designed to operate discreetly and silently to avoid escalating sensitive situations.

5.Operational Areas and Technical Requirements

The Service is only available within Wakil's designated operational areas, as communicated through the app or website.

Response capabilities depend on:

• Location
• Time of day
• Operational capacity
• External circumstances

Outside primary operational areas, assistance is provided on a best effort basis.

The Service requires a functioning smartphone, compatible operating system, active connectivity, and enabled location services. Wakil is not responsible for failures caused by technical limitations beyond its control.

6.Response Resources and Third Parties

Wakil coordinates response through trained personnel and associated response resources.

Wakil may, where appropriate, coordinate with public emergency services or authorities. Wakil does not replace police, ambulance, or other emergency services and does not guarantee that such services will be engaged.

7.User Responsibilities

The User agrees to:

• Use the Service only for its intended purpose
• Maintain the security of their account and credentials
• Ensure that all provided information is accurate
• Prevent unauthorized access to the Service

The User must not:

• Trigger alerts without reasonable cause
• Use the Service on behalf of others
• Misrepresent their identity or location
• Use the Service in a way that endangers others

8.Misuse, Suspension, and Termination

Wakil reserves the right, at its sole discretion, to temporarily suspend or permanently terminate access to the Service if Wakil reasonably suspects misuse.

Misuse includes, but is not limited to:

• False or unnecessary alerts
• Repeated alerts without reasonable cause
• Use for purposes other than personal safety
• Triggering alerts from incorrect locations
• Any behavior that risks personnel, responders, or third parties
• Any action undermining the integrity of the Service

Wakil may suspend or terminate access without prior notice where continued access poses a safety, operational, or reputational risk.

Permanent termination due to misuse is non-refundable, and Wakil may block future access.

9.Pricing, Payment, and Refunds

Pricing for the Service is displayed in the app or on Wakil's website and may be adjusted with prior notice.

Payments are processed via third-party payment providers. Subscriptions renew automatically until cancelled.

Refunds are not provided for unused periods unless required by applicable law.

10.Limitation of Liability

Wakil provides the Service with reasonable care but makes no warranties regarding outcomes, prevention of harm, or response times.

To the maximum extent permitted by law:

• Wakil is not liable for indirect or consequential damages
• Wakil's total liability is limited to the fees paid by the User during the preceding six (6) months

11.Force Majeure

Wakil is not liable for failure to perform due to events beyond reasonable control, including but not limited to network outages, power failures, natural disasters, civil unrest, strikes, or governmental actions.

12.Security and Data Protection

Wakil implements reasonable security measures to protect user data. Personal data is processed in accordance with Wakil's Privacy Policy.

Anonymized data may be used for operational and statistical purposes.

13.Intellectual Property Rights

All intellectual property rights relating to the Service remain the exclusive property of Wakil.

The User is granted a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms.

14.Subcontractors and Partners

Wakil may use subcontractors, partners, or third parties to provide parts of the Service.

15.Complaints and Support

Questions or complaints regarding the Service may be directed to Wakil's customer support via the contact details provided on the website or in the app.

16.Marketing Communications

Wakil may send service-related communications and, where permitted, marketing messages. Users may opt out of marketing communications at any time.

17.Term and Cancellation

The Agreement is valid until terminated.

Users may cancel their subscription at any time via the app or relevant app store. Paid periods are non-refundable.

18.Amendments to the Terms

Wakil may amend these Terms from time to time. Updated Terms will be made available prior to taking effect.

Continued use of the Service constitutes acceptance of the amended Terms.

19.Modification or Discontinuation of the Service

Wakil reserves the right to modify, suspend, or discontinue the Service at any time. Wakil is not liable for any resulting inconvenience or loss.

20.Governing Law and Jurisdiction

These Terms are governed by applicable local law. Any disputes shall be resolved by the competent courts of the applicable jurisdiction.
